TERMS & CONDITIONS :
1.1 - These general terms and conditions of sale (hereinafter the "GTC") apply to the website of the Peter Polo online shop (hereinafter the "website") as well as to orders placed on the website.
1.2 – We thank you for reading the GTC carefully before placing your order on the website. Access to certain parts of the website as well as orders placed on the website are subject to the application of these GTC. We advise you to make a copy of these GTC in order to be able to refer to them later.
1.3 - These GTC apply to metropolitan France and are available only in French.Article 2. The sales contract
2.1 - Your order constitutes the acceptance of our offer and in particular the acceptance of the proposed price and the designated products. Accordingly, when you confirm your order, you agree to be bound by the sales contract. We undertake to honor the orders we receive within the limits of available stocks. If the product you ordered is no longer available, we will notify you and cancel your order for the product that is no longer available. In the event that only some of the products ordered are no longer available, we will process the order for the available products and we will inform you in the "delivery email" of the unavailability of the other products. The order relating to products that are no longer available will be cancelled if necessary.
The acceptance of the order is subject to the validation of your payment.
If your payment should not be validated by the credit card issuer, or if it should prove fraudulent, or in case of reasonable suspicion of fraud, your order will not be accepted and will be automatically canceled.
2.2 - If you do not have to comply with the provisions of these GTC and in particular the provisions of Article 8 (3) which requires that the delivered goods be returned in their original condition, or if you do not have to have paid Peter Polo for any of your orders, Peter Polo reserves the right to refuse your future orders.
Article 3. The order
3.1 - If you select items from our product range, click on "add to cart" to be added in the "Verification & Payment" category. Once you have selected the shopping cart, you agree, by clicking on "proceed to payment", to purchase all the items that are in the basket. By accepting our offer, the sales contract is concluded and you are bound by this contract.
3.2 - Before placing an order, you can at any time check and modify the details of your orders by clicking on "Verification & Payment".3.3 - When you have placed an order, you will automatically receive an email confirming your order ("confirmation email") and recalling the details. We recommend that you print this email and keep it. This email confirms that we have received your order.
3.4 - We remind you that these GTC apply to metropolitan France and the European Union and that as such, Peter Polo does not accept orders whose place of delivery is located outside French territory. These GTC also do not apply to the overseas departments and territories.
3.5 - When your items are shipped, a second email will be sent to you ("delivery email") that will tell you the shipment of your order and the tracking number of the package.
Article 4. The creation of a personnal account
4.1 - In order to simplify your orders on our website, we offer you to create a personal account. If you take advantage of this possibility, all the personal data you provide to us during the account creation process will be stored in our database and you will not have to provide it with each new order. Your data will be automatically entered in the order form.
4.2 - In order to register, you must send us the following information using the online registration form: your surname, first name, address, date of birth, email address and if applicable the delivery address if different. These informations are memorized in our database conforom to the conditions link to the personnal datas protection that you could see here.4.3 - After you created your personal account, an email will be automatically sent to you confirming that your account has been created. Your email address will be used as your account ID. During the registration of the account, you will be asked to create your password. You will have the option to change it when you log in to your account. You must keep your username and password confidential and not disclose them to an unauthorized third party. You will be solely responsible for any abuse of your username and password.
Article 5. Shipping period
5.1 - It will be indicated in the delivery email the probable delivery time of the items you have ordered. This delivery time is usually two to four working days from the date of sending the delivery email. The products you have ordered will be delivered to you within the deadlines indicated in the delivery email.
5.2 - Although we make every effort to deliver your order to you on the date indicated in the delivery email, it may happen that the period is longer than expected. In the event that we cannot comply with the date indicated in the delivery email, we will notify you as soon as possible and indicate a new delivery date. However, if the delay should exceed ten days, you have the possibility to cancel your order within a period not exceeding 30 working days. If you should receive the items ordered after your cancellation request, we will refund the items ordered as soon as they are fully returned to us and in their original condition.
5.3 – If you have placed multiple orders, we may need to make multiple deliveries. If this were to be the case, we would notify you in advance.
Article 6. Price and shipping costs
6.1 - The prices indicated on the website are prices all taxes included. Peter Polo reserves the right to change its prices at any time but the products will be invoiced on the basis of the rates in force at the time of registration of the orders.
6.2 - The prices indicated on the website do not include delivery costs. Delivery costs are offered from 80€ of order in Metropolitan France. If you decide to cancel your order and return the ordered items to us, the return shipping costs are at your responsibility.
Article 7. Payments, default on your payments
7.1 – The payment for the items ordered must be made by credit card as indicated at the time of payment. The credit cards accepted are: visa / cb / eurocard and mastercard. All your purchase transactions take place within a strict framework of confidentiality and encryption thanks to the ssl protocol.
In accordance with our commitment to payment security, we verify the reliability of the information entered when registering an order. This approach is part of our desire to fight against fraud in means of payment on the Internet and the protect of all consumers.
7.2 - The full price will be charged to your card at the time of validation of your order and before any shipment. You certify to us that you are the holder of the credit card used. Credit card checks and authorizations are performed by the card issuer. If the card issuer refuse the payment authorization, you order will not be accepted and we will not be responsibles of the late of the delivery.
8.1 - If for any reason you should not be satisfied with the items ordered, you have the right to return these items and receive a full refund. The costs of reshipment are the responsibility of the customer.
8.2 - This right can be exercised within 30 days after receipt of the products ordered by sending a written notification. The written notification must be sent to the following address: [email protected]
8.3 - You can claim a full refund of returned products provided that:
a) return the items ordered with the return form to: PETER POLO DIFFUSION, Impasse Dedion Bouton, 13300 Salon-de-Provence, during the 30 days following delivery of the items;
For orders in Metropolitan France, returns are free and can be requested at [email protected]. Only one free return per order.
For orders outside France, the return is your responsibility.
8.4 - We will refund your payment in full by crediting the credit card used in your order, within thirty days of receipt of the returned items in accordance with Article 8 (3) (b).
8.5 – We asking you to take care of the products and to return us to the addess indicates at the article 8 (3) (b).
8.6 - Please note that if you fail to take care of the items or if we do not return them to us, we will take any legal action against you for compensation for the damage suffered. We also reserve the right to exclude you from any use of our website.
8.7 - If we have not received your items within a reasonable time of your cancellation, we reserve the right to send a courier to the delivery address in order to pick them up there. The costs incurred for the recovery of the items will be your responsibility.
8.8 - Peter Polo is under no obligation to accept returns and refund items that do not meet the conditions set out in Article 8 (3) (b). Items that are not accepted by Peter Polo will be returned to you.
Article 9. Defective products
9.1 – If the products that you have ordered have a default or don’t correspond to the description on the website, we thank you to contact us in the best period to [email protected]
We thank you to return the products which present a default with the return form and we will proceed to their replacement if these articles are availables or to their reimburse.

10.2 - Cookies

11.2 - We shall also not be liable for any loss or damage that may be caused to you if your online purchases were to be intended for resale, for commercial purposes or for any purpose other than those provided for in Article 2 (3).

11.5 - We cannot be held responsible for delays or breaches of the obligations provided for in these GTC if these delays or failures occur due to an event beyond our control. Such events include, but are not limited to, the paralysis of transport infrastructure, government intervention, wars, civil insurrections, hostage-taking, fires, floods, accidents, storms, strikes, terrorist attacks or any industrial event likely to affect our service or that of our suppliers.

12.1 - The use of the website does not confer on you any copyright, designs and models, trademark rights or any other intellectual property rights (or intellectual property rights belonging to third parties).

13.2 - Orders / sales placed on our website, as well as these GTC will be subject to French laws and any dispute that may arise on the occasion of the aforementioned orders / sales will be subject to the non-exclusive jurisdiction of the French courts.
13.3 - In the event that one of the provisions of these GTC is deemed null and void or illegal, the validity and legality of the other provisions will not be affected.
